Description

Description

This work provides an accurate and comprehensive scientific analysis of the content of the right to the protection of communication privacy; primarily, it attempts to define its boundaries when its exercise is subject to restrictions, in order to serve national security and criminal enforcement as aspects of the public interest.

The motivation for writing is largely connected to the heated context of expanded surveillance practices that dominated domestic political discourse during the period from 2022 onwards. Although several thematic units inevitably engage with this context, the critical analysis is conducted solely based on factual data obtained from multiple cross-verified sources, as well as from the comparative lessons of scientific theory and case law pragmatism. The extensive bibliographic and case law references, the effort to understand and evaluate legal solutions implemented abroad, and the density of citations contribute to a thorough – as comprehensive as possible – documentation, primarily aiming to provide arguments in favor of a balanced weighing between protecting the right and national security.

The work concludes with an extensive epilogue by X. Rammos, offering a comprehensive view of the most significant issues, presenting critical assessments and conclusions.
